The exact origin or legal basis of the Red Notice had not been fully disclosed to the client, but its impact was clear: he was unable to travel, settle legally in a safer environment, or secure stable opportunities for his family. His primary objective was to resolve the situation lawfully and urgently, with the well-being of his child as the driving force.

Legal Strategy: Humanitarian Grounds for Red Notice Cancellation

This case required immediate legal attention not only due to the procedural uncertainty of the Red Notice but also because of pressing humanitarian concerns. INTERPOL’s legal framework — particularly Article 2 of its Constitution — obligates the organization to respect human rights, and this includes the right to family life and protection from unnecessary suffering.

As part of the Red Notice cancellation, we prepared a submission for the Commission for the Control of INTERPOL’s Files (CCF), arguing that the notice causes unjustified harm, lacks updated legal action from the requesting country, and obstructs the client’s fundamental rights under international law.

Result

The case is now under review by the CCF. While the Red Notice remains active during the process, the client has received legal guidance on safe jurisdictions and interim travel restrictions. The submission emphasizes humanitarian protection, procedural fairness, and INTERPOL’s duty to avoid enabling disproportionate restrictions. The legal team continues to monitor the case and is prepared to pursue further remedies if necessary.
