Red Notice Removal After Politically Tainted Conviction in Romania

A client convicted in Romania in a politically motivated case sought legal help to remove an INTERPOL Red Notice issued years later. The conviction was based on association with his politically targeted brother, not on individual wrongdoing.

Case Overview

A client approached our team after receiving a 24-year prison sentence in Romania for financial crimes allegedly linked to his older brother — a businessman with a history of political conflict with the Romanian government. Although the client was only a worker in the same company and had no active role in its management, he was prosecuted and convicted alongside his brother during what appeared to be a politically charged case.

The client maintained his innocence, stating he was never involved in the alleged offenses. Years later, he found himself subject to an INTERPOL Red Notice, preventing him from traveling or working freely, and sought our help to challenge the notice and restore his international legal standing.

Legal Strategy: Challenging Red Notices Based on Political and Associative Prosecution

The key legal complexity in this case was the political context surrounding the original conviction. INTERPOL strictly prohibits involvement in politically motivated cases under Article 3 of its Constitution. Our goal was to demonstrate that the client’s prosecution was not based on individual criminal actions, but rather on association with a politically targeted relative.

Led by Dr. Anatoliy Yarovyi, our legal team began by gathering documentation related to the client’s trial, sentencing, and subsequent restrictions. We then prepared a comprehensive submission to INTERPOL’s Commission for the Control of Files (CCF), arguing that the Red Notice was issued in breach of INTERPOL’s legal framework.

As part of our argument, we highlighted due process concerns, a lack of direct evidence linking the client to the crimes, and the broader political campaign targeting his brother. The case also relied on principles of fairness, proportionality, and the client’s limited role within the business.

With years of experience in INTERPOL Red Notice removal, Dr. Yarovyi ensured that the submission addressed both legal and humanitarian elements to maximize the chance of success.

Result

The case is now under formal review by the CCF. While the Red Notice remains active during the process, the client has received legal documentation confirming the ongoing challenge, which may assist in reducing travel restrictions. Our legal team continues to support the client with both INTERPOL strategy and potential legal remedies through international human rights mechanisms. The goal is clear: full removal of the Red Notice and recognition of the injustice behind its issuance.
